CRUSHING CORPORATE COLONIZATION



In regard to the writing of the constitution, the maudlin idea that it was just the framers has to be tossed. The authors were part of a privileged class fighting for their specific rights. The same goes for judicial decision from the beginning of this nation till now, those in the judicial camp were not free from their own values and class bias.

U.S. public policy has always been influenced by those who had something to gain, they were and are not a disengaged group. Commercial media is not neutral, civic decisions by a technical elite, the corporate takeover of public life and culture is not some disengaged activity!



In the academic realm the absence of texts with historical reality is part of what has been used to shape public law, and makes one believe that judges are some objective group of beings. Corporate rule is made to seem inevitable, and that to try to overthrow it is impossible. Individual liberty in the court room has been curtailed, while corporate rights have been ever expanding. It makes the abuses of wealth and power appear to be the status quo, the cost of doing business, and something that can only have limited reform.




These manufactured perceptions are what causes public apathy when facing and trying to undo this corporate beast. We must keep in mind that court doctrine is mutable, and that great public agitation can shift the political climate. We have got to learn that judicial decisions based on the outdated idea of elevating property rights above human rights can be broken! It is merely our perceptions, moulded by this biased environment, that holds us back.



REVOLUTIONARY IDEAS

So they want to use property rights against the people, we have to look at how property has definitively changed over time. Historically property has always been looked at as goods we own, like household items. When talking about land it was originally taken over by nobles for themselves, it separated the rich from the poor - the rich being few and the poor being the majority of the people.

This also isolated the poor from food sources, and the nobles used forced labor so the poor had to depend on them. THIS IS EXACTLY THE CONDITION WE FIND OURSELVES IN WITH CORPORATIONS, WHICH WE HAVE BEEN FORCED TO DEPEND ON FOR BASIC NEEDS.




Just as nobles of old used the law and the courts to expand their power the corporations of today do likewise. They rely on the courts to gain greater wealth and power, redefine themselves through court doctrine, and with their growing rights they gain economic influence to govern the nation.

PROPERTIED MEN WRITE LAW

As concepts of property changed corporate rights grew. In early America women, children and indentured servants were considered property. If the people became insubordinate the elite would inflict bodily punishment (early New England). People became slaves for life in some instances, and orphans and unclaimed children were forced into labor as apprentices.

Land became a private financial asset that the wealthy elite claimed by what was called a "fee simple." This eventually led to private corporate property rights to intangible properties - commercial free speech, to be able to spend money to influence referenda, access to government contracts and subsidies.



So over time corporations have amassed great physical wealth far beyond the ability of individuals, and all of the rights of individuals without the responsibilities (limited liability). To say the least this is a very unequal playing field, so that corporate private property rights excludes individuals and communities from access to commonwealth and power!

This gives corporations one more large leg up - political sovereignty, that is, the right to RULE OVER individuals and communities. This they constantly exercise through corporate owned media, which helps to limit the scope of political analysis. This power has not only been unleashed on the American people, but all over the world through the WTO and IMF, and is hedged by loaded "agreements" such as NAFTA and CAFTA.



CORPORATE RULE IS RULE BY PROPERTY !

Corporations now have more revenue than many nations, they rules behind closed doors and are veritable dictatorships on a global scale. There are several points we must grasp and argue against corporations:

1). To say that the distribution of property cannot be modified by law, is like saying political power can never be changed;

2). Not all things produced are good, and take human life and human value away, other principles rather than labor and productivity are needed to justify any system of property law. Property should be distributed in regard to the productive needs of the community;

3). Private property on a large scale limits freedom. Short term profit will always win out against social interest. It does away with "free" competition by depleting the commons.

CORPORATIONS SHOULD BE RULED AS PUBLIC, NOT PRIVATE



What private corporate interest is not public? Most private property rights of corporations involve public domain - lands, minerals, public media is needed to have government free of corporate influence, so that we might be self-governing people.

We demand that a certain number of corporations charters be revoked, on the basis of damage suffered by the people (fill in the blanks)! Those who have acted against the public welfare, their property must be taken away and distributed among the people for the good of the people and land that has suffered damages.



PEOPLE MUST BE IN CHARGE OF THE INSTITUTIONS, LET'S GET THIS STRAIGHT! INSTITUTIONS ARE CHARGED TO SERVE THE PUBLIC INTEREST. IF NECESSARY CORPORATIONS MUST BE DOWNSIZED IF THEY EXPLOIT WORKERS OVERSEAS WITH STARVATION WAGES.

HISTORY HAS AMPLY PROVEN THAT COMMUNAL CONTROL IS NECESSARY TO PREVENT THE ABUSES OF PRIVATE ENTERPRISE, WHICH ARISES FROM THE ACCUMULATION AND CONCENTRATION OF WEALTH. TO TRY TO MAINTAIN ENDLESS ECONOMIC GROWTH AND SHORT TERM PROFIT FOR THE FEW PUTS CORPORATIONS IN THE POSITION OF  IMPERIAL , DICTATORIAL POWER!

LIFE IS TOO PRECIOUS AND SHORT TO HAND OVER SOVEREIGNTY AND GOVERNANCE TO THOSE WHO ARE SYSTEMATICALLY REWARDED FOR PLACING MONEY ABOVE EVERYTHING ELSE!
